Глубокоуважаемый господин Президент!

Мы обращаемся к Вам по делу досмотра личных вещей заместителя председателя Организации украинцев России (ОУР), председателя Библиотечного совета Библиотеки украинской литературы в Москве (БУЛ), члена нашей Комиссии Юрия Кононенко, осуществленного 11 мая с.г. представителями Федеральной Таможенной службы в помещении Володарского таможенного поста.

Все факты проведенного досмотра подробно изложены в официальном обращении Юрия Кононенко к ФТС, которое прилагается. Наша Комиссия, не отрицая право ФТС на досмотр личных вещей граждан при пересечении границы, желает обратить Ваше внимание на следующие факты:

1) Досмотр проводился при усиленном составе группы (три таможенника и сержант милиции), тогда как обычно досмотр проводится одним таможенником.

2) В частных разговорах таможенники подтвердили, что тщательный досмотр проводился по указанию сверху. При этом очевидно, что за Юрием Кононенко проводилось слежка еще из Киева, поскольку был известен номер рейса,  вагон и купе его следования.

3) Удивительно, что досмотр личных вещей занял целых 6 часов и, при этом, так и не был закончен. Некоторые материалы, в частности публикация статьи членов нашей Комиссии об убийствах украинских активистов в России, были изъяты для дальнейшей экспертизы.

4) Пребывая в помещении ФТС Володарского таможенного поста, Юрий Кононенко, согласно закону, подал официальное заявление в ФТС с просьбой сообщить ему о результатах досмотра. К сожалению, до сего времени он не получил официального ответа, хотя установленный законом двухнедельный срок уже истек.

Отметим, что Юрий Кононенко является одним из руководителей Объединения украинцев России, широко известным энтузиастом украинской книги и одним из создателей Библиотеки украинской литературы в Москве. Напомним также, что на протяжении последнего года активно нагнеталась конфликтная ситуация вокруг Библиотеки украинской литературы в Москве, очевидно с целью ее закрытия. В этом принимали участие, как некоторые чиновники Правительства Москвы, так и члены подмосковного молодежного политически - "экологического" движения "Местные".

Исходя из приведенной совокупности фактов, мы считаем, что, во-первых, неизвестные силы задействовали ФТС в целях оказать дальнейшее давление на Библиотеку украинской литературы в Москве и ее работников. В данном случае имеет место попытка усложнить доставку украиноязычных материалов в фонды Библиотеки. Во-вторых, мы считаем, что за фактом изъятия копии публикации статьи КЧГП "Нет — убийствам и расправам!", посвященной не расследованным убийствам украинских активистов в России, кроется попытка  власти России скрыть позорную правду об этих трагических событиях, которые продолжают происходить и по сей день (последнее убийство датировано декабрем 2006 года). Напомним, что президент ВКУ Аскольд Лозинский в марте этого года обратился к Вам с письмом по делу об убийствах и нападениях на активистов, но ответа так и не получил. Все это лишний раз свидетельствует о равнодушии власти России в этом деле.

Мы требуем защитить БУЛ и ее работников от незаконного давления некоторых представителей российских властей, возвратить Юрию Кононенко его личные вещи, предоставить согласно закону официальный ответ из ФТС о результатах экспертизы его личных вещей.

Мы желаем Вам успеха в Вашем служении на благо всех народов Российской Федерации.

Honourable President Putin,

We are writing to you in the matter of the search, on 11 May 2007 by members of the Russian Federal Customs Service at the Volodarski customs post, of the personal effects of Mr. Yuriy Kononenko, head of the Council of the Ukrainian Library in Moscow and a member of our Commission. All details regarding this search are presented in Mr. Kononenko’s official submission to the Russian Federal Customs Service, which is appended hereto. Our Commission understands the right of the Russian Federal Customs Service to examine the personal effects of persons who cross the border. However, we wish to bring the following points to your attention:

1. The search was conducted by a group of three officials of the Customs Service as well as one police sergeant, and not by a single official, as is the usual procedure.
2. During conversations the Customs officials acknowledged that this detailed examination was conducted at the orders of higher authorities. It seems evident that Mr. Kononenko was being watched from the time of his boarding in Kyiv, given that the train, carriage and compartment numbers were known to the Customs officials.
3. It is odd that the examination of Mr. Kononenko’s personal effects lasted for six hours. Some materials, particularly a publication by members of our Commission about the killings of leading members of the Ukrainian minority in Russia, were taken away.
4. In accordance with regulations, Mr. Kononenko, while still in the Volodarski customs post, submitted an official request to the Russian Federal Customs Service that he be informed of the results of the search. However, he has not received an official reply from the Russian Federal Customs Service, even though the statutory limit of two weeks for receipt of an official reply has already passed.

We wish to point out that Mr. Yiriy Kononenko is a leading member of the Association of Ukrainians of Russia, a widely known enthusiast of Ukrainian-language books and one of the co-founders of the of the Library of Ukrainian Literature in Moscow. Please be reminded that during the past year there were concerted efforts at creating a situation of conflict regarding this Library, probably with the aim of closing down the Library. Some members of the Moscow City Administration as well as the “Miestnyie” political “ecological” youth group participated in these efforts.

Given all the above, it seems that the officials of the Russian Federal Customs Service were directed to take part in the continuation of pressure on the Library of Ukrainian Literature in Moscow and its workers. In this particular case it seems that an effort was made to interfere with the supply of Ukrainian-language materials to the Library holdings. Furthermore, it appears that the confiscation of the publication “No to killings and vengeance”, which details the uninvestigated killings of activists of the Ukrainian community of Russia, is an effort by Russian authorities to cover up the truth about these ongoing tragic events (the last such killing occurred in December 2006). May we point out that Mr. Askold Lozynskyj, President of the Ukrainian World Congress, wrote to you in March of this year about these assaults and killings, however a reply has not been received to date. This is a further indication of the negligent attitude of the Russian authorities regarding these matters.

We appeal to you to ensure protection for the Library of Ukrainian Literature in Moscow and its workers from unwarranted and unlawful actions by some members of the Russian authorities as well as the return of the personal items confiscated from Mr. Kononenko. We expect that Mr. Kononenko shall receive an official reply from the Russian Federal Customs Service, as is his legal right, about the results of the examination of his personal effects.

We wish you success in your service for the good of all peoples of the Russian Federation.
